Divorce Mediation clients

I was recently asked at a networking breakfast if I ever had to fire a client.  The answer is yes.  Divorce Mediation may or may not be right for you.  At Westfield Mediation, LLC, during the first meeting we explain how divorce works in New Jersey, how divorce mediation proceeds and how Westfield Mediation, LLC, functions.  It may sound like it is a good fit for your needs.  And a majority of the time it may well be.  We have a high success rate.  This means that a large majority of the people who begin the divorce mediation process with Westfield Mediation, LLC, are able to resolve all of their issues and not have to resort to a lawyer or go to the judge to settle their matters.

However, there was a time when a client started the process, knowing what was expected of them when it came to the finances.  We were able to help them develop a parenting plan that addressed their children’s needs.  Then when we moved onto the financial piece of the puzzle, it became quite clear that the husband’s actual income well exceeded his reported income.  He made a lot of money and lived a very nice life style, even though he only reported to the IRS that he made $75,000, when his lifestyle reflected he made more like $375,000.  Well that makes a big difference when it comes to how much you are expected to pay for child support.  He got a little nervous when we pointed this out, but his wife got a lot nervous.  She had signed the now apparent misguided tax returns too.  She decided, per our suggestion, that perhaps she needed to see a lawyer and mediation was not going to work for them.  She agreed and mediation stopped.

Divorce mediation is not a way to “get away” with hiding assets.  We are not a party to illegal accounting.  So, if it comes to light, we will suggest alternatives, other than mediation.  But, if you are honestly engaged in the process, we are happy to help you with your divorce.

Same-Sex Divorce

Divorce mediation is a valuable alternative to litigation for everyone – both opposite-sex divorcing couples and same-sex divorcing couples. While the United States Supreme Court legalized same-sex marriage nationwide last week, in New Jersey, same-sex marriage has been the law of the land since 2013.  And in New Jersey, same-sex married couples who want to divorce follow the same process as opposite-sex married couples.

At Westfield Mediation, LLC, we help divorcing couples reach agreements on parenting, child support, division of assets and debts and spousal support.  For many couples, mediation is a better path than litigation because it saves time and money, and it allows spouses to work together to create an agreement that works for their family. 

While the general divorce process is the same for all divorcing couples, as part of their divorce, some same-sex couples may have to contend with additional issues.  For example, if they had a civil union before they were married, steps must be taken to terminate this union as well.  In addition, depending on how they created their family, they may need to clarify some parenting issues regarding the children of the marriage.  All of these concerns can be addressed in a mediated divorce.
